The BBC producer who was punched by Jeremy Clarkson in March has launched a personal injury and racial discrimination claim against the presenter and the BBC.
The incident, on 2 March, which left Oisin Tymon with a swollen and bloody lip, led to Clarkson's suspension from Top Gear.
Slater and Gordon, the law firm acting on behalf of Tymon, launched the lawsuit today at a London employment tribunal. According to the Daily Telegraph Tymon is apparently seeking damages of more than £100,000. The producer is said to be suing Clarkson for the injuries sustained during the attack, and the BBC for failing to protect their employee.
Clarkson allegedly called Tymon a "lazy Irish c***", which is understood to be the basis for the racial discrimination element of the claim, says the Daily Telegraph. Clarkson is reportedly willing to settle, but months of talks are yet to reach an agreement and Tymon's solicitors are trying to force a deal, says the newspaper.
Representatives for Tymon, Clarkson and the BBC have said they will not be commenting.
An investigation into the attack, led by BBC director Ken MacQuarrie, concluded that Tymon was "subject to an unprovoked physical and verbal attack by Jeremy Clarkson" at a hotel in North Yorkshire while the crew was filming on location.
"During the physical attack Oisin Tymon was struck, resulting in swelling and bleeding to his lip," said MacQuarrie. "The verbal abuse was sustained over a longer period, both at the time of the physical attack and subsequently."
The verbal abuse was said to contain "the strongest expletives" and threats to sack Tymon, and was at such volume that it was heard in other rooms of the hotel.
"Derogatory and abusive language, relating to Oisin Tymon and other members of the Top Gear team, continued to be used by Jeremy Clarkson inside the hotel, in the presence of others, for a sustained period of time," said MacQuarrie.

Jeremy Clarkson’s Top Gear years are to feature in a “two‐part extravaganza” on the BBC this Christmas, with star guests presenting highlights of the motoring show before his controversial departure earlier this year.
It is not known whether Top Gear: From A to Z will include “F for fracas” – the description used by the BBC for the incident in which the presenter assaulted a producer.
Rather than “I for injury” following the decision by the producer Oisin Tymon to sue the broadcaster and Clarkson for racial discrimination and personal injury, publicity material for the BBC2 Top Gear special suggested that “I” could stand for “inch high”.
Voiced by John Bishop, the “daft alphabet” idea, will feature unnamed Top Gear fans highlighting its “brilliant journalism, beautiful photography and the trio of middle-aged men who sat at the heart of the show”.
Clarkson is now making a show with fellow former presenters James May and Richard Hammond for rival subscription service Amazon Prime, while Chris Evans is fronting a new version of Top Gear that is scheduled to air next year.
Among other festive BBC highlights announced on Tuesday is a BBC1 penguin documentary narrated by Kate Winslet. Snow Chick – a follow-up to the successful natural history series Penguins: Spy in the Huddle – follows a baby emperor penguin’s struggle for survival in the Antarctic as it faces temperatures of -60C and a battle for supremacy against rival Adélie penguins.
The BBC will also showcase Dickensian, a new series using Scrooge, Fagin and Miss Havisham, as well as an adaptation of the bestselling crime novel of all time, Agatha Christie’s And Then There Were None, starring Poldark actor Aidan Turner.
The corporation’s Christmas schedules will feature festive specials of popular shows such as Doctor Who, Call the Midwife, Top of the Pops and EastEnders as well as a new sketch show from David Walliams, featuring Joanna Lumley, plus an adaptation of his children’s book Billionaire Boy.
Children will also be catered for with an adaptation of Julia Donaldson’s book Stick Man and festive editions of revived TV classics The Clangers and Danger Mouse.

Mozda bude i bolji TopGear. Svakako bih voleo kada bi fokus vise bio na automobilima, a manje na zabavljackom aspektu emisije.

Uz ovu ekipu mi deluje da bi moglo otici u tom smeru i bas bi voleo da se to desi. Vrhunska produkcija, odlicni vozaci i fokus na automobile, eventualno neku egzoticnu lokaciju za test i to je to. Ona tri ludaka su svakako ostala bez ideja, bar sto se mene tice, nakon 18. ili 19. sezone sam prestao i da pratim. Pokusao posle par epizoda na silu, ali nisam izdrzao. Mislim da im je vrhunac bio izmedju 14. i 18. sezone, meni su to bile sjajne epizode, sve do jedne.Dusan napisao:Svakako bih voleo kada bi fokus vise bio na automobilima, a manje na zabavljackom aspektu emisije.
